Criminal Confrontation for Drug Offenses in Penal Legislations.

Abstract

Drug-related crimes are serious crimes that obstruct the human and economic development in societies and they are transnational. Therefore, it is imperative for those who are considering its legalization in the Iraqi legislations to study their legal treatments in other countries. This study is based on the qualitative approach to explain the elements of these crimes and their penalties in accordance with the legal rules contained in the national laws such as the Iraqi Penal Code No. 111 of 1969 and the Iraqi Narcotic Drugs and Psychotropic Substances Code No. 50 of 2017. This study has found that most of the criminal legislations have not agreed on a precise definition for the narcotic drugs and psychotropic substances. Rather they were mentioned in the form of schedules and categories defined by these laws that considered the abuse and dealing with these categories a crime punishable by law. This study recommended that the penalties imposed on perpetrators of such crimes should be tightened and that the current penalties stipulated in the laws that punish those dealing with this type of crimes should be reconsidered.
