Abstract

The current study aims to identifying the role of the insolvency agent in the insolvency procedures, in a manner consistent with the necessitating reasons for the new Jordanian Insolvency law No. 21 of 2018, where the legislator, by specifying the duties of the insolvency agent in insolvency, ensured the preservation of the project whenever possible. The study showed that the agent in insolvency has a wide range of tasks in managing the bankruptcy and its procedures, and that the work carried out by the bankruptcy is subject to the insolvency procedures also in controlling the creditors. The current study has concluded that it is necessary to stipulate the provisions of civil and criminal responsibility of the insolvency agent with reference to the insolvency law, and compare it with general rules, also the agent must be subjected into training courses before they obtain his licenses, since the legislator did not limit the practice of the agency work to legal practitioners.
