Abstract

Performance achievement of the RI Attorney's Asset Recovery Center is not significant compared to the state losses found by ICW and several bid requests are still piling up. This causes a difference between the estimated price and the post-auction price due to the depreciation of the goods, resulting in reduced financial returns to the state. Many factors have contributed to the non-optimal implementation of the auction due to the unavailability of the budget to settle confiscated objects and/or confiscated goods, including maintenance and auctions; Limited storage space capacity with too many confiscated items and loot. The purpose of this study was to determine the mechanism for returning assets from the proceeds of Corruption Crimes carried out by the Center for Asset Recovery of the Prosecutor's Office of the Republic of Indonesia and to obtain a model for the reconstruction of the mechanism for returning assets from the proceeds of Corruption Crimes by the Center for Returning Assets from the Prosecutor's Office of the Republic of Indonesia which provides benefits and justice. Type of research is a sociological legal research this research includes problem solution research. Data collection techniques using virtually research are computer-based secondary data search using Information Technology (IT), library research and in-depth interviews. The validity of the data used is Triangulation. The data analysis technique in this dissertation uses the technical analysis of deduction. The deduction method is a method that starts from the submission of the major premise which is then proposed by the minor premise and from the two premises a conclusion is then drawn. One of the reconstruction methods to return assets resulting from Corruption Crimes by the Center for Returning the Assets of the Prosecutor's Office of the Republic of Indonesia that provides benefits and justice is to carry out Rule Breaking Actions in the form of Asset Confiscation. The first step in implementing progressive law to restore the proceeds of corruption is to confiscate.
